LITIGATION & DISPUTE RESOLUTION
In Cyprus the term litigation refers to the legal process of resolving disputes through the court system which is divided into two tiers, the District Courts and the Supreme Court. In civil litigation, the burden of proof lies with the party making the claim - "Ei incumbit probatio qui dicit, non qui negat" - and the court in making its decision will consider the evidence presented by both parties on the basis of the balance of probabilities.
Alternative dispute resolution methods are also available in Cyprus with mediation and arbitration clauses being greatly encouraged and increasingly been used in all forms of agreements.
